These terms and conditions apply to the MonthBox: Photos by Date app (hereby referred to as "Application") for mobile devices that was created by Pablo Butron (hereby referred to as "Service Provider") as a Freemium service.
Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application. These terms are in addition to Apple's Licensed Application End User License Agreement (EULA), which also applies to your use of the Application. If the two conflict, the Apple EULA prevails.
MonthBox is a utility that groups the photos and videos in your device's Photo Library by date and packages them into ZIP files you can share. You acknowledge and agree that:
Grouping relies on the creation date stored with each photo or video. Items with a missing or incorrect date may appear in the wrong group or in the Undated group. Weeks follow the ISO 8601 standard and start on Monday.
Photos and videos stored in iCloud Photos must be downloaded to your device before they can be added to a ZIP. If an item cannot be downloaded or read (for example because of a poor connection, low storage or an iCloud problem), the Application skips it and tells you how many items were skipped. You are responsible for checking that a ZIP contains what you need before relying on it.
The Application is free to download. The free version groups by month, shares one month at a time with up to 50 items per ZIP, and keeps your latest ZIP in History. MonthBox Pro adds grouping by day, week and year, several groups in one ZIP, no item limit, and up to 10 ZIPs in History. MonthBox Pro is offered as:
Payment is charged to your Apple Account at confirmation of purchase. The yearly subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period. Prices are shown in the Application before you buy and may vary by country.
If a free trial is offered, you will not be charged during the trial. Unless you cancel at least 24 hours before the trial ends, the subscription starts automatically and you will be charged the yearly price. Any unused portion of a free trial is forfeited when you purchase a subscription or the Single Purchase.
You can manage or cancel your subscription in your App Store account settings after purchase. Cancelling stops future renewals; MonthBox Pro stays active until the end of the period you already paid for. If you reinstall the Application or use a new device signed in to the same Apple Account, tap Restore on the MonthBox Pro screen to restore your purchase.
All purchases are processed by Apple. The Service Provider cannot issue refunds directly. You can request a refund from Apple at reportaproblem.apple.com, subject to Apple's policies.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE APPLICATION IS AT YOUR SOLE RISK. THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. THE SERVICE PROVIDER DOES NOT WARRANT THAT EXPORTS WILL BE COMPLETE OR ERROR-FREE, OR THAT THE APPLICATION WILL BE UNINTERRUPTED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE SERVICE PROVIDER BE LIABLE FOR ANY LOSS OF DATA, PHOTOS OR VIDEOS, INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APPLICATION, OR TO ANY FILE YOU SHARE USING IT. IN NO EVENT SHALL THE SERVICE PROVIDER’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID FOR THE APPLICATION OR MONTHBOX PRO IN THE TWELVE MONTHS BEFORE THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS LESS.
Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider. Your photos and videos remain yours.
The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or change the price of their services at any time and for any reason. The Service Provider assures you that any charges for the Application or its premium services will be clearly communicated to you before you pay. Price changes do not affect purchases you have already made.
The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on the functionality of the Application. The Application is currently available as per the requirements for the operating system, and you will need to download the updates if you want to continue using the Application.
It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advises against jailbreaking your phone. Such actions could expose your phone to malware, compromise your phone's security features, and may result in the Application not functioning correctly.
Creating a ZIP needs free storage on your device roughly equal to the size of the photos and videos you include. The Service Provider cannot be held responsible if an export fails because your device runs out of storage.
Downloading photos from iCloud Photos requires an internet connection. If you are using the Application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. By using the Application, you accept responsibility for any such charges, including roaming data charges.
The Service Provider may wish to cease providing the Application and may terminate its use at any time without providing termination notice to you. Unless they inform you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must cease using the Application, and delete it from your device.
The Service Provider may periodically update their Terms and Conditions. Therefore, you are advised to review this page regularly for any changes. The Service Provider will notify you of any changes by posting the new Terms and Conditions on this page.
